Sending the other class suit to the District Legal Aid Officer for mediation (ADR)

Seen. Perused the materials available on the record. Upon such perusal, it appears that this lawsuit is instituted with prayers for a declaration of title and recovery of possession by ejectment. The written statement (W.S.) has been submitted today. On the apparent face of the record, it also transpires that only a plaintiff and a defendant are involved as parties in this suit. Furthermore, they are related to one another as brothers. There are also several documentary pieces of evidence already on the record. As such, after considering the pleadings' averments and the suit’s stage, the court concludes that disputes in the suit should be referred to the concerned Legal Aid Officer, who is appointed under the 2000 Legal Aid Act, for mediation, and adjourns the hearing under section 89A of the 1908 Code of Civil Procedure. Hence, it is ORDERED that the suit be sent to the District Legal Aid Officer, Rajshahi, for mediation to settle the dispute (or disputes) in the suit.

Prepare a suit index, register it, and send the record at once.

Inform Ld. Advocates for the parties to the suit of the Order.

The next date is 25.07.2022 for the mediation report.
