The concerned Officer-in-Charge, the record room of Sadar Sub-Registrar, Rajshahi is summoned for producing the concerned volume of a registered deed and giving explanations.
Seen. Perused the materials on record. Upon such perusal, it appears that the Sadar Sub-Registrar was ordered a second time dated 30/01/2022 AD to produce the concerned volume of the Deed No. 20692 of 1972 before the court on 13.02.2022. Accordingly, the Sadar Sub-Registrar and officer-in-charge of the Sadar Record Room informed this court through a letter dated 09.02.2022. In this letter, it is mentioned that-
“রাজশাহীর সদর সাব-রেজিষ্ট্রী অফিসে রেজিস্ট্রীকৃত গত ইং ২৩/১২/১৯৭২ তারিখের দলিল নং ২০৬৯২, বালাম নং- ৭০, পাতা ৯২ হইতে ৯৪ নং পৃষ্ঠায় লিপিবদ্ধ বালামবহি খানা.... দীর্ঘ দিন যাবৎ অনুসন্ধান করিয়া যথাস্থানে খুঁজিয়া না পাওয়ায়...এবং বিগত ২০০৪ সালে পুরাতন রেকর্ডরুম হইতে নতুন রেকর্ডরুমে স্থানান্তরের সময় যে তালিকা করা হয়েছিল সে তালিকাতে ১৯৭২ সালের ৭০নং বালাম বহির উল্লেখ নাই।”
Upon perusal of the materials
available on record, the court found that the litigant parties have submitted
two Jabeda Nakol (duplicates) of the deed No. 20692/72 before the court; and
such copies of the deed in question are provided in 2012 and 2018 from the
office of the Sadar Record Room (Rajshahi) and now, those are kept on record.
It is pertinent to mention that these two certified copies of the Deed No.
20692/72 contain two different volume numbers, namely 70 and 180. As a result, the court finds inconsistency
and contradictory information displayed on the certified copies of the deed.
Hence, it is ordered that the
officer-in-charge, Sadar Record Room (Rajshahi) be present in person before the
court on the next fixed date to explain to his given information as required.
The next date is fixed on 23.02.2022 for F.P.H. Inform the concerned of this
order.
