Heard. Perused both party's petitions and the record. Upon such perusal, it appears that an ad-interim order dated 07/02/21 subsists against the defendants of the suit and is effective till the disposal of the plaintiff’s petition for temporary injunction dated 28/01/21. As the petition is still pending for disposal, the defendants are hereby restrained from changing the nature, character, and mode of possession in the suit lands by way of constructing new structures. Meanwhile, the defendant side turned up before the court and submitted W/S along with the written objection against the plaintiff’s petition for temporary injunction.
Today is fixed for hearing the plaintiff’s petition for temporary injunction dated 28/01/21. On this day, the defendant's side appears to be taking part in hearing on the petition but the plaintiff has placed a separate petition seeking for another day to be fixed for hearing on the ground of the ongoing pandemic and the hardship of court attendance by the plaintiff side themselves. The plaintiff’s time prayer for hearing on another day is not allowed on the ground that the court is now available on virtual platforms and the parties to the suit are not required to be present in person before the court. It is usual that the parties also could have participated in the hearing proceeding with remote presence along with their Ld. Advocates.
However, upon hearing the defendant side on their written objection against the plaintiff’s petition for temporary injunction dated 28/01/21, alongside their submitted documents, it appears that there makes out a clean breast of controversy with regard to the suit land; which warrants a fair opportunity of being adequately heard from both sides of the suit. Since the ongoing pandemic, particularly at Rajshahi right now, severely affects the normalcy of the courts’ function and produce hardship for the parties to the suit in many ways, it appears to the court that the petition for temporary injunction dated 28/01/21 is to be rescheduled for hearing after resuming the court’s regular function.
Meanwhile, the court is of the view that it would not cause any prejudice or irreparable loss for any party to
the suit if they are ordered to maintain status
quo till the disposal of the very petition for temporary injunction soon
after the court’s normalcy resumes. Hence, it is ordered that the parties to
the suit, plaintiffs and defendants, are hereby ordered to maintain status quo
in respect of the suit landed property scheduled to the temporary petition
dated 28/01/21. This ad-interim order shall have force till the disposal of the
very petition for temporary injunction.
